1. Acceptance & Scope of Agreement
These Terms of Service constitute a legally binding agreement between you (βUserβ, βyouβ) and Verdant Harvest Market & Organics Inc. (βVerdant Harvestβ, βweβ, βusβ). By visiting our website, adding products to your basket, or creating an account, you acknowledge that you have read, understood, and agreed to be bound by these terms.
If you do not agree with any portion of these terms, please discontinue use of our site and delivery services immediately.
2. User Accounts & Security
To place orders for delivery, you may be prompted to enter your name, physical address, and contact details. You agree to provide accurate, current, and complete information and to keep your credentials secure.
You are solely responsible for all activities that occur through your session. Please notify us immediately at security@verdantharvestgrocery.com if you suspect unauthorized access.
3. Freshness Claims & Variable Weights
We work with independent, certified organic family farms. Because our produce is grown naturally without chemical growth homogenizers, individual items (such as heirloom melons, artisan sourdough loaves, or cuts of farmhouse cheese) naturally vary in size and weight.
We strive to meet or exceed stated weights on all bagged or unit produce. If any item is substantially under the stated weight, our 100% Freshness Guarantee entitles you to an immediate proportional account adjustment.
4. Pricing, Delivery Minimums & Promo Codes
All prices are listed in U.S. Dollars ($ USD). Delivery is complimentary on all orders meeting the $35.00 cart threshold prior to sales tax. For sub-$35 orders, a standard $4.99 eco-delivery fee is applied.
Promotional codes (such as FRESH20 or FREEDEL) are valid one per customer per qualifying order and cannot be combined or converted into cash.
5. Cold-Chain Delivery & Risk of Loss
Title to and risk of loss of purchased items transfer to the customer upon delivery to the specified address. If you opt for unattended delivery, our insulated cooler totes maintain cold temperatures below 40Β°F for up to 4 hours.
Customers must ensure a safe and accessible delivery point free of aggressive unrestrained pets, locked exterior barriers without access codes, or hazardous access paths.
6. Freshness Credits & Refund Procedures
Under our 100% Freshness Guarantee, customers may request a full credit or refund for any defective or damaged item within forty-eight (48) hours of receipt. No physical return of food items is required.
Refunds are credited back to your original payment card within 2 to 5 business days, depending on your financial institution's processing times.
7. Glass Bottle Return Deposit Agreement
A refundable deposit of $2.00 is assessed on glass bottles containing milk, cream, or honey. Upon returning the intact, rinsed bottle to our delivery driver or flagship market counter, a $2.00 credit will be issued.
Chipped, shattered, or contaminated bottles cannot be re-sanitized and are ineligible for deposit credit.
8. Intellectual Property & Customer Reviews
All trademarks, logos, photographs, product descriptions, and software code on this platform are the proprietary intellectual property of Verdant Harvest Market & Organics Inc. By submitting recipe notes, reviews, or feedback, you grant us a perpetual, non-exclusive license to publish such feedback.
9. Health Disclaimers & Allergen Advisory
Nutritional information and ingredient declarations are provided for informational purposes only. While our bakery and pantry packaging adhere strictly to FDA allergen labeling guidelines, items may be processed in facilities that handle tree nuts, wheat, and dairy. Please review all ingredient labels prior to consumption.
10. Limitation of Liability
In no event shall Verdant Harvest, its founders, officers, partner farmers, or employees be liable for any indirect, punitive, incidental, or consequential damages resulting from product use or courier transit delays, exceeding the total amount paid by the customer for the applicable transaction.
11. Dispute Resolution & Arbitration
Any dispute or claim arising from these terms or your grocery orders shall be resolved via binding individual arbitration administered by the American Arbitration Association (AAA), rather than in court. You waive any right to participate in a class-action lawsuit.
